In general, if the tenancy agreement is silent on the reinstatement obligations upon expiry, the tenant is still obligated to reinstate the unit to its original condition before handing it back to the landlord. This is the industry practice, unless there is a specific clause in the agreement that exempts the tenant from such obligations.
However, if the tenant is not willing to reinstate the unit, you may negotiate with them to reach an agreement on the extent of the reinstatement works or the amount of compensation to be paid to cover the cost of reinstatement. It is important to document any agreement in writing and both parties should sign it to avoid any disputes in the future.
